GPSR fines & warnings: how high the penalties really are

A GPSR breach can hit sellers in two ways: civil-law warning letters (from ~€357 via the German VSW, over €1,600 via competitor lawyers) and administrative fines up to €100,000 under the amended §28 ProdSG. Plus the hardest sanction: delisting by marketplaces.

How high is the GPSR fine?

The German ProdSG amendment entered into force on 19 February 2026. The new §28 ProdSG has two tiers:

If the verified Responsible Person or safety details are missing, ASINs are deactivated automatically — sometimes EU-wide. A delisting in Q4 can wipe out a product's annual revenue. In almost all cases the gap was visible before the order.
